(联合国12日综合电)数十名联合国独立人权专家日前发表共同声明,针对美国和以色列官员日前向国际刑事法院(ICC)发出的威胁表示“极度失望”。国际刑事法院近日著手调查以色列军方和巴勒斯坦民兵自2014年起的战争罪指控,不排除对以色列总理和哈马斯领袖发出逮捕令。
美国众议院议长约翰逊上月29日回应,ICC的逮捕令简直“不受法律约束”,如果美国政府放任ICC行动,美国外交和军事人员未来或有可能成为逮捕对象。

众议院外交委员会主席麦考尔透露,国会在研议针对ICC官员的制裁,并补充“希望不会走到这一步。”
联合国独立人权专家表示,在全球应当团结终止加沙的流血事件时,却看到部分国家的官员威胁对追求国际正义的国际刑事法院进行报复,令人痛心;看到自诩为法治拥护者的国家试图恐吓独立、公正的国际法庭,以阻挠追究责任, 令人震惊。
威胁采取报复行动已经违反禁止攻击司法人员的人权准则,也超出公认的言论自由范围。
5月4日,国际刑事法院检察官办公室谴责有关威胁采取报复行动的言论。办公室声明提醒所有人,根据《罗马规约》第70条,威胁报复可能构成危害司法罪。
专家呼吁所有国家尊重法院作为司法机构的独立性,并保护法院工作人员的独立性和公正性。
他们表示,世界上大多数国家都支持国际刑事法院,阻碍ICC的工作不仅对巴勒斯坦地区产生不良影响,也不利于国际司法体系。专家们已与以色列和美国针对本次问题进行沟通。(中时)
