(聯合國12日綜合電)數十名聯合國獨立人權專家日前發表共同聲明,針對美國和以色列官員日前向國際刑事法院(ICC)發出的威脅表示“極度失望”。國際刑事法院近日著手調查以色列軍方和巴勒斯坦民兵自2014年起的戰爭罪指控,不排除對以色列總理和哈馬斯領袖發出逮捕令。
美國眾議院議長約翰遜上月29日回應,ICC的逮捕令簡直“不受法律約束”,如果美國政府放任ICC行動,美國外交和軍事人員未來或有可能成為逮捕對象。

眾議院外交委員會主席麥考爾透露,國會在研議針對ICC官員的制裁,並補充“希望不會走到這一步。”
聯合國獨立人權專家表示,在全球應當團結終止加沙的流血事件時,卻看到部分國家的官員威脅對追求國際正義的國際刑事法院進行報復,令人痛心;看到自詡為法治擁護者的國家試圖恐嚇獨立、公正的國際法庭,以阻撓追究責任, 令人震驚。
威脅採取報復行動已經違反禁止攻擊司法人員的人權準則,也超出公認的言論自由範圍。
5月4日,國際刑事法院檢察官辦公室譴責有關威脅採取報復行動的言論。辦公室聲明提醒所有人,根據《羅馬規約》第70條,威脅報復可能構成危害司法罪。
專家呼籲所有國家尊重法院作為司法機構的獨立性,並保護法院工作人員的獨立性和公正性。
他們表示,世界上大多數國家都支持國際刑事法院,阻礙ICC的工作不僅對巴勒斯坦地區產生不良影響,也不利於國際司法體系。專家們已與以色列和美國針對本次問題進行溝通。(中時)
